NEW YORK, August 24, 2026– The Supreme Court of the United States gives the Trump administration the go-ahead to go ahead with large-scale job cuts across all government departments, disregarding previous orders made by the lower courts which were halting layoffs until further proceedings on legal matters were made. This decision, issued in the case Trump v. AFGE, was made late last week, and the layoffs will be done under the executive order and guidance of the Department of Government Efficiency (DOGE).
This is just another victory for the government in the courts, as it had won support for its moves, such as deporting migrants without a hearing and banning transgender people from joining the military, before the Supreme Court. In the present case, the court chose not to define the positions in the government that would be subject to these layoffs.
These job cuts have been influenced by the DOGE program, a program of efficiency aimed at reducing the number of federal employees in the United States, spearheaded by the billionaire entrepreneur Elon Musk. As of April 2025, over 260,000 federal workers had left their positions due to resignations, retirements and terminations as a result of the DOGE program.
The federal employee unions and the Democrats have asserted that such cuts violate civil service provisions and might affect important functions of the government, including veteran benefits and food safety inspections. According to them, the approach adopted by the administration undermines the legal process of downsizing the workforce and poses a threat to creating chaos for agencies operating under a tight budget. The administration, however, asserts that the cuts will help eliminate waste and focus on core functions.
The decision by the Supreme Court does not address the underlying issues of legality regarding the layoff of employees; it just allows them to go ahead as the cases move along in court. This means that employees and agencies have to prepare themselves for the impact of the staffing cuts even as the judges deliberate on the issue of legality.
